A teacher in New Jersey has been arrested on charges he taped a 9-year-old student to his desk for nearly an hour. Meanwhile, an assistant teacher was accused of failing to intervene.

Lenox Elementary School teacher Todd Lewis placed duct tape around the boy’s neck and held it on a student’s desk for about 40 to 50 minutes one day in October. as Sally Anne Scala was in the classroom but failed to intervene, the victim said, according to the Pompton Lakes Police Department.

Lewis, 57, is charged with one count of second-degree harassment, endangering the welfare of a child, and Scala, 67, is charged with fourth-degree child abuse and neglect.

Police said Lewis appeared for arraignment on Thursday. After he had received an arrest warrant the day before. He was released pending trial with a special release condition that he have no contact with any children.

Scala received the complaint on Wednesday.

If found guilty Lewis could face five to 10 years in prison, while Scala could face up to 18 months in prison.

The school district superintendent said Lewis and Scala were suspended and banned from campus.
