Justice rejects 2nd Amendment arguments from illegal immigrants living in Ohio

A federal judge has rejected a request to dismiss gun charges against an illegal immigrant from Ohio who has been in the United States for more than 15 years, rejecting the man’s argument that he has a right to bear arms.

Carlos Serrano-Restrepo Charged earlier this year and was later sued for possession of a firearm by an illegal alien in the United States. According to WSYX–

The Bureau of Alcohol, Tobacco, Firearms and Explosives began investigating and monitoring Serrano-Restrepo. after he purchased at least 22 firearms and claimed to be a U.S. citizen. in firearms form

Serrano-Restrepo said some of the guns were purchased for self-defense.

Photos taken by authorities at his home showed he kept a gun in a gun cabinet. Some handguns were also mounted in holsters on the closet walls.

The suspect’s attorneys filed a motion to dismiss charges that he has a Second Amendment right to bear arms.

A judge denied his request to dismiss the case Thursday. He wrote in his opinion that “Disarming illegal immigrants like Mr. Serrano-Restrepo. who did not swear allegiance to the United States It is consistent with the history and tradition of the nation’s firearms regulations.”

“Challenging as used by Mr. Serrano-Restrepo. Lacks merit,” the judge continued. “The oath of allegiance is made through the naturalization process. Not through his asylum application or the length of his stay in the United States.”
